Zmiany w Kodeksie pracy w 2023 r. objęły swoim zasięgiem szereg obszarów związanych z zatrudnianiem pracowników. Jednym z nich jest badanie pracownika na obecność w organizmie alkoholu lub innych środków odurzających, np. narkotyków.

Rozporządzenie z dnia 16 lutego 2023 r. w sprawie badań na obecność alkoholu lub środków działających podobnie do alkoholu w organizmie pracownika, określa warunki i metody przeprowadzania badania trzeźwości przez pracodawcę lub uprawniony przez niego organ. Sprawdzana będzie obecność w organizmie alkoholu i środków działających podobnie do alkoholu.

Wprowadzenie rozporządzenia w sprawie badania trzeźwości pracowników jest dla pracodawców dokumentem, który w sposób szczegółowy pokazuje zasady przeprowadzenia takich czynności. Pracodawca musi się więc ściśle stosować do wytycznych w tym rozporządzeniu. Oznacza to również dla firmy pewne obowiązki i wymusza zakup niezbędnych akcesoriów do przeprowadzenia badania.

Co do warunków i metod przeprowadzania badań, to z przepisów rozporządzenia wynika, że może ono zostać przeprowadzone przez pracodawcę oraz przez uprawniony organ powołany do ochrony porządku publicznego lub zlecanych przez ten organ. Organem do ochrony porządku publicznego jest policja, a to oznacza, że badanie trzeźwości może zostać przeprowadzone przez ten organ lub może on zlecić np. pobranie krwi czy moczu służbom medycznym. W rozporządzeniu jest jeszcze wzmianka, że jeżeli pobranie krwi może spowodować zagrożenie życia lub zdrowia osoby badanej, decyzję o pobraniu krwi lub odstąpieniu od jej pobrania podejmuje lekarz.

Wewnętrzne uregulowania w tym zakresie nie zostały jeszcze wprowadzone w Zakładzie Ubezpieczeń Społecznych.
